On Eagle's Wings Multi-Purpose Centre respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains, in plain language, what personal information we collect through this website, why we collect it, how we use and protect it, and the rights you have under South African law. Because of the nature of our work with survivors of violence and abuse, we take confidentiality extremely seriously.

1. Who We Are (Responsible Party)

On Eagle's Wings Multi-Purpose Centre ("On Eagle's Wings", "we", "us", "our") is a registered non-profit organisation and non-profit company based at Shop 9, Aspen Building, 18 Jeffrey Street, Jeffreys Bay, Eastern Cape, 6330, South Africa. We serve the greater Kouga and Kou-Kamma regions.

Under the Protection of Personal Information Act, we are the "responsible party" for the personal information we collect through our website at www.oewmpc.co.za and when you contact us directly.

2. Our Commitment to POPIA

We process personal information in accordance with the Protection of Personal Information Act (POPIA), Act 4 of 2013. This means we will only collect, use, and store your personal information lawfully, for clearly defined and legitimate purposes, in a way that is adequate, relevant, and not excessive, and with your knowledge and consent where the law requires it.

3. Information We Collect

3.1 Information you give us directly

When you contact us through the contact form on this website, by email, or by telephone, we may collect:

  • Your name
  • Your email address
  • Your telephone number (if you choose to provide it)
  • The subject of your enquiry and the content of your message
  • Any other information you voluntarily include when you write to us or speak with our team

3.2 Information collected automatically

When you visit our website, our hosting server automatically records limited technical information in its standard access logs, including your IP address, browser type and device information, the pages you view, and the date and time of your visit. This information helps us keep the website secure and running properly. When you submit the contact form, your IP address is also recorded with your message to help us prevent abuse and spam.

We do not currently use third-party website analytics or advertising trackers. If we introduce analytics in future, we will update this policy and our cookie notice before doing so.

3.3 Special (sensitive) personal information

Given the nature of our work, information you send us, for example details about abuse, trauma, health, or your involvement with the criminal justice system, may be "special personal information" under POPIA. We treat all such information with the highest level of confidentiality. We only process it where you have given consent, where it is necessary to provide you with support or to protect your safety or that of another person, or where the law otherwise permits or requires it. We do not share it without your explicit consent unless we are legally obliged to do so.

4. How and Why We Use Your Information

We use your personal information only for the purpose for which you provided it, including to:

  • Respond to your enquiries, messages, and requests for support
  • Provide, coordinate, or refer you to counselling and support services
  • Process volunteer, student placement, partnership, and donation enquiries
  • Send you programme updates or newsletters, only if you have asked us to
  • Keep our website safe, secure, and working correctly
  • Meet our legal, funding, and reporting obligations as a registered NPO and NPC

Providing your information through our website is voluntary. However, if you do not provide the information marked as required on the contact form, we may not be able to respond to your enquiry.

5. When We Share Your Information

We do not sell, rent, or trade your personal information. We only share it in the limited circumstances below, and always with appropriate safeguards:

  • Service providers who help us operate, such as our website hosting provider and, if used, a secure payment provider. They may only process your information on our instructions and must keep it confidential.
  • Support partners and authorities, such as social workers, shelters, health services, or the South African Police Service, where this is necessary to provide you with assistance or to protect someone's safety, and, where practical, with your consent.
  • Government departments, such as the Department of Social Development, where required for NPO compliance, funding, or statutory reporting (using de-identified or aggregated data wherever possible).
  • Where the law requires it, including in response to a court order, or to meet mandatory reporting duties (for example, the reporting of child abuse or neglect under the Children's Act).

6. Information Sent Outside South Africa

Some technical service providers we rely on to display this website (for example, Google, which serves the embedded map on our Contact page and the web fonts used across the site) may process limited technical information, such as your IP address, on servers located outside South Africa. Where personal information is transferred across borders, we take reasonable steps to ensure it receives a level of protection consistent with POPIA.

7. How Long We Keep Your Information

We keep your personal information only for as long as we need it for the purpose it was collected, or for as long as the law requires. As a general guide:

  • Website enquiries and correspondence: up to 24 months after your enquiry is resolved, unless an ongoing relationship or support need requires us to keep it longer.
  • Donation and financial records: at least 5 years, as required by South African tax and financial record-keeping law.
  • Newsletter subscriptions: until you unsubscribe or ask us to remove you.
  • Confidential case records held offline as part of our support services are governed by the applicable professional and Department of Social Development retention requirements.

When we no longer need your information, we delete or securely destroy it, or de-identify it so it can no longer be linked to you.

8. Cookies and Similar Technologies

This website does not set its own advertising or tracking cookies. To remember that you have seen and accepted our cookie notice, we store a single small preference in your browser's local storage (named "oew-cookie-accepted"). This stays on your own device and is not shared with us or anyone else.

Certain third-party features may set their own cookies or process technical data when they load, in particular the Google Maps location map on our Contact page and the Google-hosted web fonts used across the site. These are provided by Google and are governed by Google's privacy policy. You can block or delete cookies at any time through your browser settings, though some features (such as the map) may then not work as intended.

9. Children's Personal Information

We understand that children and young people may reach out to us. POPIA gives special protection to the personal information of children (persons under 18). Where we knowingly collect a child's personal information through this website, we do so only with the consent of a parent or legal guardian, or where it is necessary to protect the child's safety or best interests, or as otherwise permitted by law. 10. Newsletters and Direct Marketing

We will only send you newsletters, updates, or appeals by email if you have chosen to receive them. Every such message will include a simple way to unsubscribe, and you can ask us to stop at any time by emailing admin@oneagleswingsjbay.co.za. We will never sell your contact details or pass them to other organisations for their own marketing.

11. Your Rights Under POPIA

You have the right to:

  • Access - request confirmation of, and a copy of, the personal information we hold about you
  • Correction - ask us to correct information that is inaccurate or incomplete
  • Deletion - ask us to delete or destroy your information, subject to our legal obligations
  • Objection - object, on reasonable grounds, to our processing of your information
  • Withdraw consent - withdraw your consent at any time where our processing is based on it (this does not affect processing already carried out)
  • Complain - lodge a complaint with the Information Regulator of South Africa

12. How We Protect Your Information

We take reasonable and appropriate technical and organisational steps to protect your personal information against loss, damage, misuse, and unauthorised access. These include serving the website over a secure encrypted (HTTPS) connection, applying website security controls, limiting staff access to information on a need-to-know basis, and reviewing our security from time to time. Enquiries submitted through the contact form are delivered to our team by email. No method of transmission over the internet is completely secure, so while we work hard to protect your information, we cannot guarantee absolute security. If a data breach affecting your information occurs, we will act promptly and notify you and the Information Regulator where the law requires it.

13. Links to Other Websites

Our website may contain links to external websites, such as our Facebook page or, in future, a payment provider. We are not responsible for the privacy practices or content of those websites. We encourage you to read their privacy policies before sharing your information with them.

14. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or the law. The current version will always be posted on this page with a revised "Last updated" date at the top. Please check back occasionally so you stay informed.
